Social media terms and conditions

1. All references to Tourism Tasmania, "we", "us", "our" and any other applicable term in this document are to be taken to mean The Crown in Right of Tasmania as represented by Tourism Tasmania. Tourism Tasmania does not represent any other Crown entity in Tasmania.

These channels are collectively referred to as "Our Channels" in these Terms.

3. User Content and Permissions

  3.1    In these Terms "User Content" refers to photos, videos (including sound), accompanying text, captions, or any other creative content posted through your social media account.

  3.2 Tourism Tasmania does not claim ownership of your User Content. You retain full ownership and all intellectual property rights in your User Content.

  3.3    Using the hashtag #discovertasmania or tagging our accounts does not automatically grant us permission to use your User Content.

  3.4    When we see User Content we wish to feature, we will contact you directly via email or a direct message on the platform you posted the User Content to request your express permission.

  3.5    Permission is only granted when you respond affirmatively to our request, such as by replying "yes" or giving clear written consent. A lack of response does not indicate permission.

  3.6    If you grant permission, you give us a non-exclusive, royalty-free, revocable, non-transferable licence to re-share your User Content on Our Channels only. This means we can:

a)   share your content organically (not as paid advertising) on our social media accounts;

b)  crop or resize your content to meet platform technical requirements; and

c)  add captions, credits, or hashtags to your content.

  3.7    We will not use your User Content for any of the following purposes:

a)  our website (discovertasmania.com.au), printed materials, brochures, or publications;

b) paid advertising or boosted posts;

c) marketing campaigns outside of organic social media sharing;

d) our visual image library;

e) sharing with trade partners or third-party organisations; or

f)  trade events, exhibitions, or presentations.

  3.8    If we wish to use your User Content for any of these purposes in the future, we will contact you separately to request additional permission.

  3.9    You warrant that our use of your User Content as described in these Terms will not infringe intellectual property, privacy, publicity, or other rights of any third party, require payment to any third party, or breach any applicable laws.

4. Credit and Revocation

  4.1 When we re-share your User Content, we will always credit you by tagging your username/handle in the caption and, where possible, linking to your profile.

  4.2 You can revoke permission at any time by emailing dataprotectionofficer@tourism.tas.gov.au with your username, the platform, and a description or link to the content.

  4.3 When you revoke permission, we will:

a) acknowledge your request within 2 business days;

b) immediately stop using your User Content in new posts; and

c) remove posts featuring your User Content from our social media channels within 5 business days.

  4.4 We cannot guarantee removal from third-party platforms or content that has been shared by others.

  4.5 We will not destroy government records held for the purposes of the Archives Act 1983 (Tas). This does not affect our obligation to remove your content from Our Channels within 5 business days of your revocation request.

  4.6 You will hold Tourism Tasmania harmless and indemnify the Crown in Right of Tasmania against any claims by third parties arising from your User Content, including for breach of intellectual property, data protection, privacy, image, performance, or publicity rights.

5. Personal Information

  5.1 By agreeing to these Terms you consent to Tourism Tasmania processing any personal information in your User Content for the purposes described in these Terms.

  5.2 If any other person appears in your User Content, you warrant you have obtained their consent for us to use the content.

 5.3 Tourism Tasmania will handle personal information of any third parties appearing in your User Content in accordance with our Privacy Statement, and only to the extent necessary for the purposes described in these Terms.

  5.4 Tourism Tasmania will process personal information in accordance with the Personal Information Protection Act 2004 (Tas), and our Privacy Policy available at https://www.tourismtasmania.com.au/legal/privacy/.

  5.5 Under the Personal Information Protection Act 2004 (Tas) you have the right to access or correct personal information Tourism Tasmania holds about you, and to make a privacy complaint. To exercise these rights, contact our Data Protection Officer at dataprotectionofficer@tourism.tas.gov.au. If you are not satisfied with our response, you may complain to the Tasmanian Ombudsman at http://www.ombudsman.tas.gov.au

6. You confirm you are at least 18 years old. If under 18, a parent or legal guardian must grant permission on your behalf.

7. You must comply with the terms of service and community guidelines of the social media platform you are using. When you use those social media platforms, those platforms' terms and privacy policies also apply. We do not control these third-party platforms.

8. Content Standards and Moderation

  8.1 Your User Content must comply with our Community Guidelines, which set out standards for acceptable content and behaviour on our channels.

  8.2 We reserve the right to decline to use User Content, or to remove content we have previously shared, if it:

a) violates our Community Guidelines;

b) violates platform terms of service;

c) contains illegal material;

d) could harm Tourism Tasmania's reputation; or

e) is otherwise deemed inappropriate by us for sharing on our Channels.

9. These Terms are governed by the laws of Tasmania, Australia.

10. If any provision of these Terms is invalid or unenforceable, that provision will be severed and the remaining provisions will continue in effect.

11. We may modify these Terms at any time by updating the "Last Updated" date above.

12. Disclaimer of Responsibility

  12.1 While we moderate our channels in accordance with our Community Guidelines, we do not pre-screen all User Content.

  12.2 User Content does not necessarily represent the views or opinions of Tourism Tasmania or the Crown in Right of Tasmania.

  12.3 We do not confirm or warrant the accuracy of information in User Content. Tourism experiences vary. Always verify current information with providers before making travel decisions.

  12.4 We are not responsible for third-party websites or platforms, including the social media platforms our channels operate on.

Acceptance of Terms

By providing express permission when we contact you, you confirm that:

a) you have read and agree to these Terms;

b) you have the legal capacity to enter into these Terms;

c) you are 18 or older (or have guardian consent);

d) you have all necessary rights to grant the license; and

e) all warranties you have made are true and accurate.

If you do not agree with these Terms, do not grant permission when we contact you.
